The short version: by joining our waitlist or using Visibly, you agree to use the service fairly and legally, and we'll do our best to give you an accurate, useful product. The full detail is below.

1. Who these terms apply to

These Terms of Use ("Terms") govern your access to and use of the Visibly website at getvisibly.co.uk, our waitlist and newsletter, and — once launched — the Visibly platform itself (together, the "Service"), operated by Visibly ("we," "us," "our"). By visiting our website, joining our waitlist, or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. What Visibly currently offers

Visibly is currently in early access. The Service today consists of our website, a free brand visibility scan, and a waitlist/newsletter you can join to be notified when full access launches. The full Visibly platform — ongoing AI visibility monitoring, competitor tracking, and recommendations — is under active development and not yet generally available. Features, pricing, and availability described on our website may change before general launch.

3. Eligibility

Visibly is a business-to-business product intended for marketing professionals and organisations. You must be at least 18 years old and have the authority to act on behalf of any organisation you represent when using the Service.

Once account creation is available, you'll be responsible for keeping your login credentials secure and for all activity that happens under your account. Let us know immediately at [email protected] if you believe your account has been accessed without authorisation.

6. The free brand scan

Our free brand scan is provided as a sample of Visibly's capability. Results are generated by querying AI engines at the time of your scan and are intended to be illustrative and directional rather than a guaranteed, real-time measurement. We may limit the number of free scans available to any individual or organisation.

7. Fees and payment (future paid plans)

When paid plans become available, pricing will be clearly displayed before you subscribe. Payments will be processed securely by our payment provider, Stripe; we do not store your full card details ourselves. Subscriptions renew automatically unless cancelled, and specific cancellation and refund terms will be confirmed at the point paid plans launch.

8. Intellectual property

The Visibly name, logo, website design, and underlying software are owned by us and protected by intellectual property law. You're welcome to use the Service for its intended purpose, but you may not copy, reproduce, or create derivative works from our branding, design, or platform without our written permission. Any brand, competitor, or account data you submit to the Service remains yours; we use it only to provide the Service to you.

9. Third-party AI engines and data

Visibly monitors and reports on how brands appear in third-party AI engines (such as ChatGPT, Gemini, Perplexity, Claude, and Copilot). We don't control these engines, and their outputs can change, be inconsistent, or be inaccurate. Visibly's reporting reflects what these engines returned at the time of querying and should be treated as a useful signal, not a guaranteed or permanent measurement of brand visibility.

The Service, including the website, free scan, and future platform, is provided "as is." While we work hard to keep it accurate and reliable, we don't guarantee that it will be uninterrupted, error-free, or that any recommendations will produce specific business results. Visibly is not a substitute for your own professional judgement.

11. Limitation of liability

To the extent permitted by law, Visibly will not be liable for any indirect, incidental, or consequential losses arising from your use of the Service. Nothing in these Terms limits liability for things that can't legally be limited, such as death or personal injury caused by negligence, or fraud.

12. Termination

You may stop using the Service, unsubscribe from our newsletter, or close your account at any time. We may suspend or terminate access to the Service if these Terms are breached, or where reasonably necessary to protect the Service or other users.

13. Changes to these Terms

We may update these Terms as Visibly grows and the Service evolves. If we make material changes, we'll update the date at the top of this page and, where appropriate, notify existing users by email.

14. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
